Plant
& Animals Welfare Society – Mumbai lodge a writing complaint against a
person who thrown a PET DOG from a top (height) floor of Lake Lucerne
(Building), Lake Home (Complex), Powai at 9:45 PM on 3rd June 2013. In
the letter PAWS-Mumbai requested Powai Police to lodge and FIR against unknown
person under Prevention of Cruelty to Animals Act, 1960, Indian Penal Code,
1860 and Bombay Police Act, 1951 and investigates the case as a law enforcement
authority.
As per
the information received PAWS-Mumbai “It fell a far distance of about 15 ft.
from the balconies onto a car and nobody cared to lend a hand or help to
identify the dog. It was left to die with a crushed skull and absolutely no
trace of the owners. Its body was left overnight at the same spot with no
action being taken for more than 15 hours. It is the most horrendous case of
animal cruelty, as the heartless owner was as good as the devil incarnate to
throw the puppy out with full force and not even come to claim it or own up.
The death cannot even be accidental, as pugs cannot jump or slip through the
railings as the grills on the balconies are narrow. Even if it slipped out, it
could never fall that far away from the balconies”.

After
accepting the PAWS-Mumbai written complaint, on 6th June 2013, Powai
Police have recorded the statement of Sunish.
PAWS-Mumbai appeal to the resident of

What the law says………..
PREVENTION OF CRUELTY TO ANIMALS ACT, 1960 Under Section 11
OFFENCE
Beating, kicking, overriding, torturing
or causing any animal pain or suffering by the owner or any other person.
PENALTY
All these offences are punishable with
a fine or with imprisonment for a term, which may extend to three months or
with both.
INDIAN PENAL CODE,
1860 Under Section
428, 429
OFFENCE
Mischief of killing or maiming of an
animal of any value above ten rupees. This includes bulls, oxen, horses, mules,
camels etc.
PENALTY
The offender shall be punishable with
imprisonment for six months or with fine, which may extend to two thousand
rupees or with both.
BOMBAY
POLICE ACT, 1951 Under Section 73 to 78 & 99
Under this Act the
Police has been give special powers to take action, when an animal offence has
been committed.
When a Police Officer has reason to believe an offence under Section 11 and 12 of the Prevention of Cruelty to Animals Act has occurred, he may seize the animal and take it to a veterinary office.

The police officer
can keep the animal in a dispensary before it is produced before a magistrate,
so long as the time does not exceed three days. A Police Officer may unsaddle
or unload an animal he suspects is unfit or too sick to carry out the work it
is doing.
A Police Officer may arrest, without a warrant from a magistrate, any person committing in his presence any offence publishable under the Prevention of Cruelty to Animal Act.
