Bad NEWS : Bijli DIED !

Sunday, June 30, 2013 : The 60 years elephant Bijli fighting for survival finally end her hope.

Its time owner of the Bijli should throw behind bars. Bijli is 2nd Elephant died due to forest department not taken timely step to stop the illegal commercial activities of the Elephant owners in Mumbai, Navi Mumbai & Thane area.
Plant & Animals Welfare Society – Mumbai (PAWS-Mumbai) have lodged a written complaint with Mulund Police and Mumbai Range Forests Office but till now no action has been taken or given any response to the complaint.

PAWS-Mumbai appeal to the citizen to raise their voice against animal cruelty and who exploit poor animal by using it for begging, selling their body parts, joy ride, entertainment, etc. After a long age work without any proper food, health care, shelter the animal die helplessly and the law enforcement authority’s like forest and police not taking any interest in legal action against the cruel owners.

PAWS-Mumbai an animal welfare organization filled an written complaint with police and forest department against owner of the elephant which is been used for begging at Kandivali

Plant & Animals Welfare Society – Mumbai an animal welfare organization lodged a written Complaint with Kandivali Police Station and Range Forest Office, Mumbai against using of Indian Elephant for begging purpose in crowded area at Kandivali (West) and nearby areas. As the Indian Elephant is listed at S.N.12-B in Schedule – 1 of the Wildlife (Protection) Amendment Act 2002 and as per the circular of Chief Conservator of Forest Thane, No.D-8(4)/WLP/OW/128/07-08, Thane 400 603, Dated 24/7/2007 it is illegal to is brought this elephant within the limits of Mumbai Municipal Corporation, Navi Mumbai Municipal Corporation and Thane Municipal Corporation. 

Not only mahout uses this elephant for begging purpose but also they are selling the hair of elephant tail and also uses for joy ride too. This kind of activities carried by Elephant owners is violation of Section 2(7A) read with Section 2 (39) 38H, 43 and 42 of Wildlife (Protection) Amendment Act 2002; Wildlife Protection Act 1972; Prevention of Cruelty to Animals Act 1960 ; Performing Animals Rules, 1973 & 2001; Indian Penal Code 1860; Bombay Police Act 1951. So we at PAWS-Mumbai requested the Police as well as the Forest Department to register an FIR against the owner in this case said Sunish Subramanian Kunju, Hony. Animal Welfare Officer of Animal Welfare Board of India and activist of PAWS-Mumbai.

It is the duty of the person who owned the elephant should carry or have all necessary document like Ownership Certificate, Transit Permit, Medical Fitness Certificate from and authorized Veterinarian, Certificate of Implantation of Microchip, Elephant Insurance Policy, etc but owner not having any such proper documents during usage in public. The ownership is give only to keep it as Pet, but this owner are violating the laws and using it for commercial purpose.

Recently Bijli a 60 Year Old Elephant met with accident and fighting for survival, which is in critical condition at Mulund as she was also forced to beg for years in the streets of Mumbai, Thane and Navi Mumbai, without any proper diet and medical care. In 2006 a female elephant that was injured in a road accident as it was hit by a speed water tanker on streets at Chembur and later died.

AWBI Secretary told to State Forest Officers after PAWS-Mumbai Complaint

Animal Welfare Board of India Secretary told to State Forest Officers on 19th June 2013 after Plant & Animals Welfare Society – Mumbai (PAWS-Mumbai) Complaint on 18 June 2013 in regards to Bijli and another elephant which the same owner, which he kept in very critical condition at Mulund.

As per the AWBI Secretary E-Mail received by PAWS-Mumbai Office  it said ............


I have spoken to Mr. Naqui, PCCF, Nagpur & Mr. Chavan, Deputy Conservator of Forests, Thane informed that the injured elephant is being taken care by the Vet and it is very badly injured in the 2 front legs and they are not able to lift the animal to any hospital due to obese condition and grave injured condition of the animal.

As per his observations, recovery may be very slow and vets are taken good care of the animals. Regarding the other animal which is being subjected to begging, Deputy Conservator of Forests is having  a view that owners is having a proper ownership certificate and they are ready to take legal action provided if any NGO will take care of rehabilitation of the elephant and the mahout. He is also taking about a NGO at Mathura who is taking care of elephants. As per direction of VC, AWBI, Board is writing letter to PCCF, Nagpur to take necessary action on the complaint by PAWS, Mumbai is the abuse of the Bijli, 60 years old elephant.
On 21 June 2013, PAWS-Mumbai Office written a letter to Deputy Conservator of Forests (T- Thane) in regards to Rehabilitation of the elephant  issue

Medical Aid for Bijli from PAWS-Mumbai Students Volunteers

Plant & Animals Welfare Society – Mumbai (PAWS-Mumbai) student volunteer’s Nisha Kunju, Hitesh Yadav (Std. 3rd of NES Primary School) , Kalpesh Pate (Std. 9th Parag Vidyalaya) and Himanshu Surve (Std.  8th of New Horizon Public School) have collected some funds and got 50 Bottles of DNS 500ml for the treatment of 60 years old elephant Bijli at Mulund, Mumbai who is fighting for survival.

Minister of Forest , Govt. of Maharashtra Dr . Patangraoji Kadam and demanded to provide urgent medical aid from the side of Forest Department to 60 yrs old elephant Bijli who is fighting for survival at Mulund, Mumbai and to lodge FIR against the owner for the cruelty act.  Total ban of elephants in the city which are been use for begging and other commercial purpose which openly violating the laws.

In past we have written many complaints about this issue but we have never received any response from any of the authority. It’s not first time but in past (year 2006) a 25 years old female elephant named Laxmi was injured in a road accident and later died . We as an Animal Welfare Organisation had given some suggestion to Forest Department too in this regarding how we can solve this issue.

It seen that even after many complaints by both citizen and animal welfare organization against many elephants been used for begging or commercial purpose which is violating various laws of animal welfare then to no action are been taken against the owners. It is clear that bringing elephant is city is itself illegal as per Circular No.D-8(4)/WLP/OW / 128/07-08, Thane 400 603, Dated 24/7/2007 of Chief Conservator of Forest Thane.

We seen that most owners of the elephants are not having proper documentation like Ownership Certificate, Transit Permit, Medical Fitness Certificate from and authorized Veterinarian, Certificate of Implantation of Microchip, Elephant Insurance Policy, etc.  So we request you to kindly look into the issue and do the needful help in the interest of the mute and un-complaining animals.

Hon. Minister of Forest , Govt. of Maharashtra Dr . Patangraoji Kadam had forwarded this letter and directed  Principal Secretary of Forests to look in to the matter.

PAWS-Mumbai lodged written Complaint ( Letter No. PAWS-Mumbai/PCA-BE/45-2013 Dated 18 June 2012 ) to Mulund Police Station & Range Forest Office, Mumbai against owner of two elephant which are abuse and neglected in Mulund, Bhandup and Thane, also used for begging etc and demanded to register an FIR against the owner.

On 12 June 2013 later the Bijli owner made her walk the
distance from the accident site to his home. This over-strain
made the elephant collapse near the house on the road.
Plant & Animals Welfare Society – Mumbai (PAWS-Mumbai) have send an written complaint letter to Mulund Police Station, Range Forest Office, Mumbai and to all authority who is responsible to look after city wildlife on 18 June 2013. Demanded to register an FIR against owner
 
In the letter send by PAWS-Mumbai which is signed by Sunish Subramanian Kunju (Founder & Secretary : PAWS-Mumbai / Hony. Animal Welfare Officer : Animal Welfare Board of India) its said .............


Despite the order Circular No.D-8(4)/WLP/OW/128/07-08, Thane 400 603, Dated 24/7/2007 of Chief Conservator of Forest Thane, there is widespread usage of Elephants by Mr & Mrs Goswami for the purpose of begging in these areas.  Also the two elephants are being neglected and abused.
On 11 June 2013 a day after Bijli was hit by
a moving vehicle at mulund and the owner is
cleaning the wound and washing the body
with water without any medical treatment



Please note that a moving vehicle had injured one elephant and later the owner made her walk the distance from the accident site to his home. This over-strain made the elephant collapse near the house on the road.

The other problems created for the animals and citizens are :

1.        The Elephants are made to walk for long distance without adequate food and water on Tar roads.

2.        The Elephants are made to walk long distance at night time too.
3.        The Elephants cause traffic jams while they are being taken from one place to another.
4.        The noise due to vehicular traffic and crackers increase the stress levels of the Elephants.
5.        The Elephants do not get proper medical treatment by their handlers when they become sick or injured.
6.        Minor children are made to sit over the Elephants and taken for joy-rides.
7.        It is hazardous to make the Elephants walk in public as they may come in “Musth”, thus risking the life and property of citizens.
 8.        The handlers / owners of the Elephants themselves are poor. Thus it is very unlikely that they would be able to feed or take proper care of these mega-herbivores who require adequate food, water and medication to live well.
9.        The owner sells the tail hairs as good-luck charms.

Please note that since the two elephants are illegally possessed and abused which violates the following laws :

  1. Prevention of Cruelty to Animals Act 1960 ;
  2. Wildlife Protection Act 1972;
  3. Indian Penal Code 1860;
  4. Bombay Police Act 1951 etc.
The elephant is now lying injured and in a serious condition at an animal hospital at Parel.  It is very likely that henceforth the owner would not be able to nurture and protect the elephant, but would subject him to further abuse and commercial use.

Also, it should be noted that this owner is in possession of another elephant which is also abused and used for begging and joy rides.  The two animals are used purely for commercial purpose by letting them out for begging on the streets and for joy-rides.   It should be noted that earlier too, due to complaints from animal-welfare groups to the Police, action has been taken by the Police and the Forest Dept. for violation of the animal protection laws. But yet the abuse and commercial use continues unabated by the owners.

Citizens have constantly complained against the presence of huge animals on the streets for commercial use and joy rides, but for reasons best known to the law-enforcement agencies, deterrent action has not been taken so far.

We urge you to do the following at the earliest :

  1. Kindly inspect the documents which prove that these two elephants are owned and transported in a legal manner into the city limit which is mandatory as per the law (e.g.  Ownership Certificate, Transit Permit, Medical Fitness Certificate from and authorized Veterinarian, Certificate of Implantation of Microchip, Elephant Insurance Policy, etc.).
  2. Inspect the availability of space and capability of the owners to keep, nurture, feed and protect the two elephants.
  3. If it is found that the two elephants are possessed illegally and ill-treated, then kindly seize them and transfer them to animal rehabilitation centre.
  4. On the basis of the investigations done by us and the news-paper reports, photographs etc. we urge you to kindly register an FIR against the owners of the elephants.
Please note that your inaction on this issue would further endanger the life, safety and well-being of these two wild animals, which could lead to even death.  You being the law-enforcement agency would be liable for punishment if the abuse of these two elephants continue, which please note.

We request you to inform us of the action taken on the above complaint as early as possible in the interest of the mute and un-complaining animals.

This animal is brought within the limits of Mumbai Municipal Corporation, Navi Mumbai Municipal Corporation and Thane Municipal Corporation. The activities carried out by Indian Elephant is in violation of section 2(7A) read with Section 2(39), 38H, 43 and 42 of Wildlife (Protection) Amendment Act 2002.
 
In order to s top this violation, it is hereby prohibited to bring or keep Indian Elephant within Mumbai Municipal Corporation, Navi Mumbai Municipal Corporation and Thane Municipal Corporation without valid ownership with conditions stipulated by Forest Department of Maharashtra, Any possession with the limits of Mumbai Municipal Corporation, Navi Mumbai Municipal Corporation and Thane Municipal Corporation without ownership certificate from Forest Department, Maharashtra is treated illegal possession and action will be taken under Wildlife (Protection) Amendment Act 2002 and other related laws.
